SUMMARY AS PASSED: (all summaries)

Refusal of blood or breath test. Allows a finding of unreasonable refusal to permit a blood or breath sample to be taken to be admissible in a criminal trial for the sole purpose of explaining the absence of a chemical test. The arresting officer and magistrate are required to inform the person arrested of the possibility that such a finding could be admissible as evidence. Removes the provision that the trial date for unreasonable refusal must be after the trial for driving under the influence.
