SUMMARY AS PASSED HOUSE:
Mining activity; surface effects of underground coal mining operation. Provides that the Director shall suspend ongoing underground coal mining under an impoundment of water used for public water supply purposes if he finds imminent danger to the public water supply.
SUMMARY AS INTRODUCED:
Mining activity; applications for permits and surface effects of underground coal mining operation. Provides that a permit application for coal surface mining operations shall not be approved unless the applicant demonstrates to the Director of the Department of Mines, Minerals and Energy that the area proposed to be mined is not located under an impoundment of water used for public water supply purposes or the immediate watershed basin of such impoundment. The bill also requires the Director to suspend ongoing underground coal mining under such impoundments and immediate watershed basin if he finds imminent danger to the public water supply. The bill provides that the term "immediate watershed basin" shall not include an area greater than one thousand acres.
