SUMMARY AS INTRODUCED:

Virginia Public Procurement Act. Clarifies the preference for Virginia firms, goods, services and construction in the case of tie bids. The bill also (i) clarifies the standard for awarding costs to a public body in the case of a contractor’s unfounded delay claim; (ii) allows a contractor to recover its costs and fees when a public body denies a legitimate delay claim made by the contractor and sets the same standard for awarding costs as in clause (i) above; (iii) provides that pre-performance contractual waivers of payment bond rights are void unless executed by the person whose right is waived after such person has first furnished labor or materials for the project; (iv) deletes from the determination of nonresponsibility the reference to a determination of responsiveness, which latter determination is already required, as a separate requirement, under the Virginia Public Procurement Act; and (v) requires better notice to contractors of locally adopted claims procedures.
