SUMMARY AS PASSED:
Public service corporation easements. Requires any instrument conveying an easement of right-of-way in land to a public service corporation to include a notice stating that the grantee may have the right to obtain some or all of the rights being conveyed through exercise of eminent domain, and that the owner has the right to choose not to convey rights that are not subject to eminent domain.
SUMMARY AS PASSED HOUSE:
Public service corporation easements. Requires any instrument conveying an easement in land to a public service corporation to include a notice stating either that (i) some or all of rights being conveyed could be obtained through exercise of the right of eminent domain, or (ii) none of the rights being conveyed could be obtained through exercise of the right of eminent domain and that the landowner has the right to choose not to convey those rights.
SUMMARY AS INTRODUCED:
Public service corporation easements. Requires any instrument voluntarily conveying an easement or other interest in land to a public service corporation to state whether the interest conveyed thereby could be acquired by the corporation through exercise of the power of eminent domain.
