015995556Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 15.2-1618.1 as follows:
§ 15.2-1618.1. Discontinuation of certain health benefits.
If a deputy sheriff is injured as a direct or proximate result of the performance of his duty, a locality shall not discontinue the health insurance benefits of such deputy sheriff, or restrict the sheriff's ability to provide such benefits, so long as the deputy sheriff is rehabilitating from such injury and drawing workers' compensation benefits. Furthermore, a locality shall allow a deputy sheriff under such circumstances to apply accumulated sick or vacation time to the worker's compensation benefits so as to prevent a decrease in total pay.
