Be it enacted by the General Assembly of Virginia:

1. That § 22.1-212.1 of the Code of Virginia is amended and reenacted as follows:

§ 22.1-212.1. Obligations of school boards; programs for students with limited English proficiency.

A. Pursuant to § 7.1-42, school boards shall have no obligation to teach the standard curriculum, except courses in foreign languages, in a language other than English.

B. School boards shall endeavor to provide instruction in the English language whichthat shall be designed to promote the education of students for whom English is a second language.

C. In the exercise of the obligation described in subsection B and in the interest of enhancing achievement through a proven instructional method, school boards shall implement English-immersion programs exclusively and shall not operate bilingual programs or English as a Second Language courses that are content oriented and conducted in a language other than English for the education of students with limited English proficiency. This subsection shall not, however, be construed to prohibit or restrict school boards in using bilingual teachers or other bilingual personnel or volunteers in communicating with limited English proficiency students and their families in their native or first language.
