WHEREAS, John H. Rust, a former mayor of Fairfax and one of the Commonwealth's foremost real estate legal experts, died on July 6, 2000; and

WHEREAS, a native and lifelong resident of Fairfax, John Rust graduated from the University of Virginia in 1937, earned his law degree in 1939, and served in the Pacific Theatre during World War II; and

WHEREAS, in 1941 John Rust served as mayor of what was then the Town of Fairfax, served later as town attorney, and played a vital role in 1961 in the community's effort to become an independent city; and

WHEREAS, John Rust served as president of the Fairfax County Bar Association from 1956 to 1957 and was appointed to the Legal Ethics Committee of the Virginia State Bar in 1957; and

WHEREAS, during his six years on the committee, John Rust studied the attorney-client relationship in real estate, resulting in the Bar's adopting an ethical rule asserting that an attorney's allegiance in real estate dealings should be to the buyer or seller, rather than the real estate agent; and

WHEREAS, John Rust later served as general counsel to the United Bank of Fairfax and was a member of the board of United Virginia Bankshares; and

WHEREAS, John Rust was the son of former state Senator John W. Rust and the father of Delegate John H. Rust, Jr.; and

WHEREAS, during a legal career that spanned more than 50 years, John Rust left a lasting imprint on the legal profession and on the City of Fairfax; now, therefore, be it

RESOLVED by the House of Delegates, the Senate concurring, That the General Assembly note with great sadness the loss of an invaluable citizen of the Commonwealth, John H. Rust; and, be it

RESOLVED FURTHER, That the Clerk of the House of Delegates prepare a copy of this resolution for presentation to the family of John H. Rust as an expression of the high regard in which his memory is held by the members of the General Assembly.
