018127264Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 18.2-152.7:2 as follows:
§ 18.2-152.7:2. Facilitating, encouraging, or inviting crimes against another person or property by using computers; penalty.
Any person who willfully uses a computer or computer network without the consent of another person to communicate that person's contact information, including but not limited to, identifying information as that term is defined in § 18.2-186.3, telephone number, street address, or electronic mail address (i) to facilitate, encourage or invite a third party to contact that person for the purpose of engaging in or threatening any illegal, obscene or immoral act, or (ii) to facilitate, encourage, or invite a third party to cause harm to the other person's property or person, and the third party attempts to cause harm to the other person's property or person, shall be guilty of Class 1 misdemeanor. Any person who violates this section where the victim is a minor, and he knew or should have known that the victim is a minor, shall be guilty of Class 6 felony.
