018927884Whereas, Garland Jay Street (Mr. Street) is a resident of Honaker, Virginia where he breeds horses; and
Whereas, one particular horse owned by Mr. Street is a black Tennessee Walker; and
Whereas, the horse had been bred with a spotted Tennessee Walker and Mr. Walker intended to sell the colt after it was born; and
Whereas, on August 4, 2000, while the horse was grazing on Mr. Street’s property, a Virginia State Police helicopter participating in a drug eradication operation suddenly appeared flying at low altitude; and
Whereas, the sudden appearance of the helicopter startled the horse causing it to run into a barbed wire fence; and
Whereas, the horse suffered a dislocated hip and various cuts and bruises; and
Whereas, the injuries suffered by the horse resulted in the loss of the colt; and
Whereas, the value of the colt is $4,850; and
Whereas, Mr. Street filed a complaint with the Department of State Police (Department) requesting payment for the lost colt; and
Whereas, by letter dated October 2, 2000, the Department denied any negligence or liability and would not provide compensation for the lost colt; and
Whereas, Garland Jay Street has no other means to obtain adequate relief except by action of this body; now, therefore,
Be it enacted by the General Assembly of Virginia:
1. § 1. That there is hereby appropriated from the general fund of the state treasury the sum of $4,850 for the relief of Garland Jay Street, to be paid with a check issued by the State Treasurer on warrant of the Comptroller upon execution of a release of all claims Mr. Street may have against the Commonwealth or any agency, instrumentality, office, employee or political subdivision in connection with the aforesaid occurrence.
