Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 33.1-185.1 as follows:

§ 33.1-185.1. Procurement of professional services.

The Virginia Department of Transportation (VDOT) shall procure professional services, as defined in § 11-37, in accordance with the Virginia Public Procurement Act (§ 11-35 et seq.) except as provided in this section. When professional services are needed for projects contained in the Virginia Transportation Development Plan, VDOT shall prepare, prior to the receipt of the Request for Proposals, an estimate of the cost of the services required. These estimates shall be utilized in the course of negotiations to arrive at a fair and reasonable price for the contract. Negotiations with the offerors deemed to be fully qualified and experienced, in the order of preference, may be conducted until a contract that offers the best value to VDOT is awarded. The procurement shall be in accordance with federal statutes and regulations governing transportation procurement activities.
