Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 10.1-1186.4 as follows:

§ 10.1-1186.4. Enforcement powers; federal court.

In addition to the authority of the State Air Pollution Control Board, the State Water Control Board, the Virginia Waste Management Board and the Director to bring actions in the courts of the Commonwealth to enforce any law, regulation, case decision, or condition of a permit or certification, such actions may be brought in the appropriate federal court where a federal agency is pursuing related or similar claims. Such actions shall be brought by the Attorney General in the name of the Commonwealth.
