Whereas, on or about May 1, 1996, William R. Frazier purchased property in Warrenton, Virginia, at a public auction; and

Whereas, at the time the property was purchased, the Virginia Department of Transportation (VDOT) was in the process of performing improvements on State Route 651 which ran across the property; and

Whereas, after purchasing the property, Mr. Frazier discovered that a fifty-foot easement had been secured by VDOT in 1994 for $10,000 from an individual who was not the legal owner of the property; and

Whereas, the $10,000 payment for the easement was in lieu of replacing fencing that would be damaged by the roadwork; and

Whereas, the roadway construction resulted in the removal of the fencing; and

Whereas, Mr. Frazier received no benefit from the $10,000 payment and will have to incur the expense of replacing the fencing; and

Whereas, despite requests by Mr. Frazier to be compensated by VDOT for the replacement of the fencing, no compensation has been forthcoming; and

Whereas, William R. Frazier has no other means to obtain compensation except by action of this body; now, therefore,

Be it enacted by the General Assembly of Virginia:

1. § 1. That there is hereby allocated from the Commonwealth Transportation Fund appropriation to the Department of Transportation the sum of $10,000 for the relief of William R. Frazier. This sum shall be paid by check issued by the State Treasurer on warrant of the Comptroller to William R. Frazier, upon execution by him of a release of all claims he may have against the Commonwealth or any agency, instrumentality, officer, employee or political subdivision thereof, in connection with the aforesaid occurrence.
