AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding a section numbered 65.2-714.1, relating to workers' compensation, payment of medical expenses after award.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 65.2-714.1 as follows:

§ 65.2-714.1. Payment of medical expenses after award of the Commission.

If the Commission finds that the employer or insurer unreasonably delayed or denied payment for medical attention described in subsection A of § 65.2-603, in addition to any other costs, interest or sanction that may apply, the Commission shall award interest to the employee, or health care provider if the health care provider has not been paid, on the amount paid for such medical attention at the judgment rate, as provided in § 6.1-330.54, from the date the bill for such medical attention was furnished to the employer or insurer until the date paid.

2. That the provisions of this act shall expire on July 1, 2003.
