017136832Be it enacted by the General Assembly of Virginia:
1. That § 15.2-915 of the Code of Virginia is amended and reenacted as follows:
§ 15.2-915. Control of firearms.
From and after January 1, 1987, no locality shall adopt any ordinance,
resolution, motion, administrative rule or regulation to govern governing the
purchase, possession, transfer, ownership, carrying or transporting of
firearms, ammunition, or components or combination thereof other than those
expressly authorized by statute. For purposes of this section, a statute that
does not refer to firearms [ , including rifles and shotguns, ] or ammunition
shall not be construed to provide express authorization.
Nothing in this section shall affect the validity or invalidity of any ordinance adopted prior to January 1, 1987. Nothing in this section shall have any effect on any pending litigation. However, no person may be prosecuted or convicted of a violation of any ordinance regulating the transportation of a firearm if he is (i) in lawful possession of the firearm and he has a valid concealed handgun permit issued pursuant to § 18.2-308 or (ii) otherwise transporting the firearm in a lawful manner.
