Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 46.2-398.1 as follows:

§ 46.2-398.1. Judicial approval for DMV revocation or suspension.

In any case in which the accused is convicted on or after July 1, 2001, of a traffic or criminal offense that triggers the administrative revocation or suspension of his driver's license or automobile registration by the Commissioner under this article, the Commissioner shall not suspend or revoke the license or registration without the prior approval of the court. The trial court may include in its order upon the final disposition of the driver's case its approval for such administrative revocation or suspension and shall apprise the driver of its approval. If such approval is not set forth in the final order, the Commissioner may petition the trial court for a hearing on the matter. The Commissioner shall give at least thirty days' written notice of the date set for hearing to the driver by registered letter to the driver's most recent address on file at the Department.
