Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 8.01-40.3 as follows:

§ 8.01-40.3. Action for injury resulting from certain unfair discrimination in contracts for life insurance, annuity contracts, and policies or contracts for accident or health insurance.

Any person aggrieved by an act prohibited by subdivision 1 or 2 of § 38.2-508 may bring an action against the person who committed the prohibited act to recover the actual damages sustained by such person, together with costs and reasonable attorneys' fees. An action brought pursuant to this section shall be commenced within two years of the date the plaintiff discovers or reasonably should have discovered the last act in the course of conduct constituting a violation of such subdivision.
