Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 11-41.2:03 as follows:

§ 11-41.2:03. Fixed-price or not-to-exceed price on design-build contracts for certain highways authorized.

Notwithstanding the provisions of § 11-41.2, the Department of Transportation may enter into contracts for the construction and reconstruction of, and improvements to, Route 28 from Route 7 in Loudoun County to Interstate 66 in Fairfax County on a fixed-price or not-to-exceed design-build basis.

Written procedures governing the selection, evaluation, and award of such design-build contracts shall be consistent with those described in this chapter for the procurement of other than professional services through competitive negotiation.
