009014620Be it enacted by the General Assembly of Virginia:
1. That § 9-6.25:3 of the Code of Virginia is amended and reenacted and that the Code of Virginia is amended by adding in Title 9 a chapter numbered 51, consisting of sections numbered 9-390 through 9-394, as follows:
§ 9-6.25:3. Supervisory boards, commissions, and councils.
There shall be, in addition to such others as may be designated in accordance with § 9-6.25, the following supervisory boards, commissions, and councils:

§ 9-390. Disaster Relief Board established; purpose.
The Disaster Relief Board (the "Board") is hereby established as a supervisory board within the meaning of § 9-6.25 in the executive branch of state government. The purpose of the Board shall be to administer and appropriate funds from the Disaster Relief Fund ("Fund") established for the benefit of victims of natural or man-made disasters.
§ 9-391. Membership; terms; chairman; compensation.
The Board shall consist of twelve members, with six members to be appointed by the Governor, three members to be appointed by the Speaker of the House of Delegates, and three members to be appointed by Privileges and Election Committee of the Senate. Of the initial appointments, four members shall serve four-year terms; four members shall serve three-year terms; and four members shall serve two-year terms. Thereafter, all members shall serve four-year terms. Any appointment to fill a vacancy shall be in the same manner as the original appointment. Any member may be reappointed for successive terms.
The Board shall appoint from its membership a chairman and a vice-chairman, both of whom shall serve at the pleasure of the Board. A majority of the Board shall constitute a quorum. The Board shall meet at least annually or upon the call of the chairman.
Members of the Board shall receive no compensation, but shall be reimbursed for all reasonable and necessary expenses incurred in the discharge of their duties as provided in § 2.1-20.8. Such expenses shall be paid from the Fund.
§ 9-392. Powers and duties of the Board.
A. The Board is hereby granted, shall have, and may exercise all powers necessary or appropriate to carry out and effectuate its purposes, including, without limitation, the following:
1. To determine how moneys in the Fund are to be distributed and to authorize distribution of moneys in the Fund for the purposes set forth in this chapter;
2. To make and execute contracts and all other instruments and agreements necessary or convenient for the exercise of its powers and functions;
3. To invest its funds as permitted by applicable law; and
4. To do any lawful act necessary or appropriate to carry out the powers herein granted or reasonably implied, including use of whatever lawful means may be necessary and appropriate to recover any payments wrongfully made from the Fund.
B. The Board shall cause moneys in the Fund to be distributed to citizens of the Commonwealth to alleviate damage, loss, hardship, or suffering caused by natural or man-made disasters, as defined in § 44-146.16, occurring on or after January 1, 1999.
§ 9-393. Staff; cooperation from other state agencies.
The Department of Emergency Services shall serve as staff to the Council. All agencies of the Commonwealth shall assist the Council, upon request.
§ 9-394. Disaster Relief Fund.
A. There is hereby created in the Department of Treasury a special nonreverting fund which shall be known as the Disaster Relief Fund, consisting of such funds as may be appropriated by the General Assembly from time to time, and any other funds from private or local sources.
B. Moneys in the Fund shall be used solely for the purposes described in this chapter, and shall be supplemental to all other funds available for such purposes, including federal funds.
C. Any moneys remaining in the fund at the end of a biennium shall not revert to the general fund, but shall remain in the fund.
