2001 SESSION
004960832Be it enacted by the General Assembly of Virginia:
1. § 1. The officials conducting the November 7, 2000, election in the Kinross, Navy, Waples Mill, and Lees Corner Precincts (Numbers 908, 911, 916, and 920, respectively) of Fairfax County shall conduct a referendum on that date to poll the voters in those precincts on the question of whether they are in favor of changes affecting Ox Road between Vale Road and Lawyers Road that raise the speed limit to more than 35 miles per hour and install sidewalks on both sides of that portion of Ox Road.
The question on the ballot shall be: “Do you favor changes affecting Ox Road between Vale Road and Lawyers Road that will raise the speed limit to more than 35 miles per hour and install sidewalks on both sides of that portion of Ox Road?”
The ballots shall be prepared and voted, the referendum shall be conducted, and the results shall be ascertained and certified, all as provided in Article 5 (§ 24.2-681 et seq.) of Chapter 6 of Title 24.2 of the Code of Virginia.
The electoral board shall cause notice of the election to be published in a newspaper of general circulation in the county at least once in the period forty-five to sixty days before the election.
If a majority of the voters in those precincts vote “yes” and in favor of the described changes to Ox Road, the Virginia Department of Transportation and other concerned state or local government agencies shall be authorized, but not required, to proceed with such changes. If a majority of the voters in those precincts vote “no” and against the described changes, the Virginia Department of Transportation and other concerned state or local government agencies shall not proceed with such changes. The effect of the referendum shall apply only to the specific changes stated in the referendum question and shall not preclude alternative improvements to Ox Road.
