Be it enacted by the General Assembly of Virginia:
1. That § 17.03 as amended and §§ 17.05 and 17.09 of Chapter 323 of the Acts of Assembly of 1950 are amended and reenacted as follows:
§ 17.03. City planning commission - Officers; meetings; records; employees; expenditures.
The commission shall elect a chairman and vice-chairman from among the citizen
members appointed by the council for a term of one year, who shall be eligible
for reelection, and appoint a secretary. The commission shall hold at least
one regular meeting each month, and shall adopt rules for the transaction of
its business. The commission shall keep a record of its resolutions,
transactions, findings and determinations showing the vote of each member on
each question or, if absent, or failing to vote, indicating such fact which
record shall be filed in the office of the commission and shall be a public
record. The commission shall appoint such employees as it may deem necessary
for its work and may contract with city planners, engineers, architects and other
consultants for services it may require. All expenditures, exclusive of gifts
to the commission, shall not exceed the sums appropriated by the council
therefor.
§ 17.05. City planning commission - Monuments and other works of art.
It shall be the further duty and function of the commission to make
recommendations to the city council to provide for the preservation of
historical landmarks; and to control, the design and location of statuary and
other works of art which are or may become the property of the city, and the
removal, relocation and alteration of any such work;, and to consider and
suggest the design of bridges, viaducts, airports, stadia, arenas, and swimming
pools, street fixtures and other public structures and appurtenances.
§ 17.09. City planning commission - Further planning powers and duties.
The commission shall have power to promote public interest in and understanding
of the plan, and to that end may publish and distribute copies of the plan or
any report relating thereto, and may employ such other means of publicity and
education as it may determine. The commission shall consult and advise with
public officials and agencies, public utility companies, civic, educational,
professional or other organizations, and with citizens, with relation to the
protection or carrying out of the plan. All public officials shall, upon
request, furnish to the commission within a reasonable time, such available
information as it may require for its work. The commission, its members, or
officers, and employees in the performance of their duties, may enter
upon any land in the city and make examinations and surveys, and place and
maintain necessary monuments and markers thereon. In general, the commission shall have such
powers as may be necessary to enable it to fulfill its function, promote planning and carry out
the purposes of this charter for which a development plan under its purview has
been tendered to make such examinations as are necessary in aid of the commission's review
authority and its planning duties and functions. The commission shall make an
annual report to the council concerning its activities.
