2001 SESSION
Be it enacted by the General Assembly of Virginia:
1. That § 28.2-820 of the Code of Virginia is amended and reenacted as follows:
§ 28.2-820. Harvesting, transporting, handling or transplanting of seed-stock shellfish.
Nothing in this chapter shall prohibit the harvesting, transporting, or
transplanting of seed-stock oysters from any public seed area, as the Marine
Resources Commission may establish by regulation The Commission shall
promulgate regulations for the harvesting, transporting, handling and transplanting of
wild and cultured seed-stock shellfish from condemned areas. The Marine
Resources Commission shall consider limitations based on the size of seed-stock
oysters shellfish which that may be harvested, methods of handling, controls on
the methods of transportation, and restrictions on the transplanting process necessary to protect the health of the public. The
Commission shall consult with the State Health Commissioner prior to the adoption of any such regulation.
