D. Notwithstanding the provisions of subsections B. and C., any permits that may be issued or regulations that may be promulgated for the sale or manufacture of cheese from any species not required to be permitted or regulated in intrastate commerce prior to July 1, 2001, shall be in accordance with the provisions of the Administrative Process Act (§ 9-6.14.1 et seq.), unless the prospective permittee or regulant indicates on a writing approved by the Commissioner that they elect to be regulated by the provisions of subsection B. and C. rather than regulations that may be promulgated in accordance with the provisions of the Administrative Process Act (§ 9-6.14.1 et seq.).
