        E. Out of the general fund appropriation for this item, the State Board of Health, in conjunction with the Board of Medicine, shall develop a program for the licensure, inspection and regulation of women's outpatient surgical clinics and physician offices that perform 25 or more abortions per year. Regulations developed pursuant to this program shall include the following minimum requirements: (i) "hospital" shall include any clinic or physician's office performing 25 or more abortions per year; (ii) any such clinic or physician's office shall be subject to all of the requirements of this article for outpatient surgical hospitals and the regulations of the Board in the same manner as any other hospital, including any standards, inspections, staffing and laboratory requirements, equipment mandates, or other criteria; (iii) abortions can be performed only by American College of Obstetrics and Gynecology certified physicians who are also licensed by the State Board of Medicine to perform abortions in Virginia; (iv) facilities and physician offices performing abortions must have an advance transfer agreement with the nearest hospital having emergency facilities and all women experiencing emergency complications must be transferred by ambulance to that hospital; (v) physicians performing abortions who reside outside the hospital catchment area must have a prior agreement with a local physician with admitting privileges at the above-mentioned hospital and all women who have an abortion must be provided the name and telephone number of this physician prior to their surgery; (vi) as part of the patient consent process, all patients must receive printed instructions detailing the expected symptoms after the abortion, precautions that should be taken, indications of complications that require being seen by a physician, and emergency telephone numbers of the physician and the above-mentioned hospital; (vii) facilities and physician offices performing abortions must conform to the blood borne pathogens standard of the U.S. Center for Disease Control and Prevention; (viii) patients may not be requested to sign a waiver of liability; (ix) all medical records of the patient must be available to her and to other health care practitioners of her choosing; (x) each facility and applicable physician office will be inspected according to the procedures utilized by the Department of Health in all other outpatient surgical facilities, in compliance with the Code of Virginia; and (xi) all abortions after the first trimester must be performed in licensed clinic or physician's offices as mandated in the Code of Virginia.

        D.1. By July 1, 2002, the Department of Medical Assistance Services shall develop, implement and administer a program known as the Virginia Prescription Drug Payment Assistance Program to assist eligible elderly and disabled Virginians in paying for prescription drugs on a first-come, first-served basis. Eligibility criteria shall require that a person have (i) an income below 200 percent of the federal poverty level or (ii) prescription drug expenses that exceed forty percent of his annual income. Also, participants must be sixty-five or older or eligible for federal Old Age Survivors and Disability Benefits and be ineligible for Medicaid prescription benefits and not be receiving a prescription drug benefit through a Medicare supplemental policy or any other third party payor prescription benefit. In the first year of the program, enrollment shall be limited to five thousand eligible Virginians. The annual benefit per eligible person shall be up to $2,500. The Department shall establish claims procedures and co-payment amounts, not to exceed twenty-five percent of cost, but not less than five dollars.

        D.2. This section shall not be construed as creating any legally enforceable right or entitlement to prescription drug coverage on the part of any eligible participant or any right or entitlement to participation.

        D.3. The Department of Medical Assistance Services shall report to the Chairmen of the House Appropriations and Senate Finance Committees by December 1, 2002, regarding participation in the program in the first year and shall make recommendations regarding the costs of fully funding this program to provide benefits for any eligible Virginian with an income below 200 percent of the federal poverty level.

        E. Out of the amount for Emergency Assistance, $10,000,000 from general funds the first year and $10,000,000 from general funds the second year shall be used to provide crisis assistance to meet emergency heating needs under the Low Income Home Energy Assistance Program. Households shall not be required to contain a vulnerable individual to receive crisis assistance from these amounts. Payments to households shall not be limited to payments for primary heating fuel. Households shall be eligible for assistance from these funds for the purchase of any home heating fuel and payment of any heat utility bill on or after December 1, 2000. Payments from these amounts may be made to any household that has previously been determined to be eligible for home heating assistance or to any other household that applies to the Department of Social Services for such assistance at any time during the year. Payments to households from these amounts may be made by credit authorization to vendors or by direct reimbursement to households for heating costs incurred upon verification of such expenditures. A paid receipt from a vendor showing payment received on or after December 1, 2000 shall constitute verification of such expenditures.

        o.1. The Commissioner of the Department of Social Services shall be paid an annual salary of $113,295 from the period of July 1, 2000, to November 24, 2000, and $116,977 from November 25, 2000, to November 24, 2001. The payment of these salary amounts shall be based on the following conditions: requests for proposals for grants for agencies and organizations applying to receive federal Temporary Assistance to Needy Families (TANF) funds for the purposes set forth in Item 390.2.b. are prepared and sent to these agencies and organizations for review at least 30 days prior to July 1 of the fiscal year for which funding has been appropriated or allocated; contracts for such agencies and organizations are executed within 30 days of the start of the fiscal year for which funding has been appropriated or allocated for the purposes set forth in Item 390.2.b.; and a monthly report detailing budgeted and actual TANF expenditures is provided to the Chairmen of the House Appropriations and Senate Finance Committees effective upon the signing of this act.

        2. If the above conditions are not met, the Department of Planning and Budget shall unallot the amounts provided for the Commissioner's salary as listed above and the Comptroller shall not issue payroll checks for that portion of Commissioner's annual salary that corresponds to the period of delay in executing the aforementioned contracts.

        3. If the above conditions are met and certified by the Auditor of Public Accounts by September 1, 2001, the Commissioner is eligible to receive an annual salary in the amount of $121,071 during the period of November 25, 2001, to June 30, 2002.
