SUMMARY AS PASSED:

Milk and milk products; penalty. Provides that the Commissioner of Agriculture and Consumer Services may impose civil penalties on individuals who violate the provisions of regulations adopted by the Board of Agriculture and Consumer Services regarding standards of quality, permits, and sanitary requirements for milk, milk products, and milk production. Civil penalties imposed by the Commissioner are to be paid into the general fund of the state treasury.

SUMMARY AS PASSED SENATE:

Milk and milk products; penalty. Provides that the Board of Agriculture and Consumer Services may adopt by reference federal regulations or industry standards in its regulations regarding standards of quality, permits and sanitary requirements for milk, milk products, and milk production. The bill authorizes the Board to impose civil penalties on individuals who violate the provisions of regulations adopted by the Board. The bill also creates the Milk Safety Fund for the purposes of administering and enforcing Board regulations. Civil penalties imposed by the Board are to be paid into the Milk Safety Fund. The bill also exempts certain regulations adopted by the Board from the provisions of the Administrative Process Act and provides for a period of public comment on such regulations.
