SUMMARY AS PASSED:
Infected sexual battery. Creates the Class 6 felony of infected sexual battery when the offender has intimate sexual contact with someone knowing he is infected with HIV, Syphilis or Hepatitis B with the intent to transmit the infection to another person.
SUMMARY AS PASSED HOUSE:
Infected sexual battery. Creates the Class 1 misdemeanor of infected sexual battery when the offender has intimate sexual contact with someone while infected with HIV, unless the offender informed the person of the offender’s diseased status or the person knew of the infection and the person consented to sexual contact. Provisions are made for enhanced penalties for subsequent acts.
