SUMMARY AS PASSED:
Election recounts and contests. Allows the petitioner and parties in a recount to examine the pollbooks and election materials at the preliminary hearing under security measures approved by the chief judge of the circuit court. The bill also allows examination of all types of ballots during the recount. With respect to contests of General Assembly elections, the bill extends the period to file notice of the intent to contest the election from 20 days after the election to either 30 days after the election or three days after the conclusion of a recount proceeding, whichever is later. Further adjustments are made in the timetable for an election contest.
SUMMARY AS INTRODUCED:
Election recounts and contests. Allows the petitioner and parties in a recount to examine the pollbooks and election materials under security measures approved by the chief judge of the circuit court. The bill adds evidence of improper voting and inaccurate vote tabulations to the scope of the recount evidence and deletes the presumption that printed returns suffice as evidence of the vote count. With respect to contests of General Assembly elections, the bill extends the period to file notice of the intent to contest the election from 20 days after the election to either 40 days after the election or three days after the conclusion of a recount proceeding, whichever is later. Further adjustments are made in the timetable for an election contest.
