000954412Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 15.2-2305.1 as follows:
§ 15.2-2305.1. Low income and disabled or senior citizen dwelling unit ordinances.
In furtherance of the purpose of providing affordable shelter for all residents of the Commonwealth, the governing body of any county, city or town may enact an ordinance requiring that the owners of new apartment projects with twenty-five units or more set aside ten percent of the units for persons of low income and older Virginians as defined in § 2.1-373, or persons with disabilities, at a rental rate of twenty-five percent less than the rate charged to other tenants. Such ordinance shall provide that all building permit fees, impact fees and sewer and water connection fees for such units be waived.
