Be it enacted by the General Assembly of Virginia:
1. That § 58.1-4004 of the Code of Virginia is amended and reenacted as follows:
§ 58.1-4004. Membership of Board; appointment; terms; vacancies; removal; expenses.
A. The Board shall consist of five six members, all of whom shall be citizens
and residents of this the Commonwealth and all of whom shall be appointed by
and serve at the pleasure of the Governor, subject to confirmation by a
majority of the members elected to each house of the General Assembly if in
session when the appointment is made, and if not in session, then at its next
succeeding session. At least one of the members appointed by the Governor shall
be the owner or operator of a retail establishment that sells Virginia lottery
tickets. Prior to the appointment of any Board members, the Governor shall
consider the political affiliation and the geographic residence of the Board members.
The members shall be appointed for terms of five years, except that of the
members first appointed, one shall be appointed for a term of five years, one
for a term of four years, one for a term of three years, one for a term of two
years, and one for a term of one year, each commencing as of the date of his
appointment. The members shall annually elect one member as chairman of the
Board.
B. Any vacancy on the Board occurring for any reason other than the expiration of a term shall be filled for the unexpired term in the same manner as the original term.
C. The members of the Board shall receive such compensation as provided in § 2.1-20.3, shall be subject to the requirements of such section, and shall be allowed reasonable expenses incurred in the performance of their official duties.
D. Before entering upon the discharge of their duties, the members of the Board shall take an oath that they will faithfully and honestly execute the duties of the office during their continuance therein and they shall give bond in such amount as may be fixed by the Governor, conditioned upon the faithful discharge of their duties. The premium on such bond shall be paid out of the State Lottery Fund.
2. That the provisions of this act shall not affect current members of the State Lottery Board whose terms have not expired as of July 1, 2000.
