Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 24.2-603.1 as follows:

§ 24.2-603.1. Time off for employees to vote.

A. If an employee who is a registered voter does not have sufficient time outside of his working hours, within which to vote at any election, he may take off time to vote pursuant to this section. If the employee has three consecutive hours or more either between the opening of the polls and the beginning of his work shift, or between the end of his work shift and the closing of the polls, he shall be deemed to have sufficient time within which to vote. He shall be entitled to no more than two hours of time off with pay in any case to obtain sufficient time to vote.

B. An employee who requires work time off to vote shall notify his employer at least two days before the election day. The employee shall be afforded time off at the beginning or the end of his work shift, as designated by the employer, or at another time mutually agreed on by the employer and employee.

C. Each employee afforded time off shall furnish to the employer proof that the employee has voted. The proof shall be on a form prescribed by the State Board.

D. Every employer shall post conspicuously in the work place, not less than ten working days before every election and through the day of the election, a notice setting forth the provisions of this section.
