000263400Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 8.01-38.2 as follows:
§8.01-38.2. Liability for participating in actions that delay transportation projects.
Any party who files an injunction against the Commonwealth of Virginia or any entity thereof for the purpose of stopping or delaying a construction project undertaken, authorized or contracted by and funded in whole or in part by the Virginia Department of Transportation or the Commonwealth Transportation Board, where the Commonwealth or any entity thereof prevails and the filing of such injunction is the direct cause of a delay of such project, shall be liable for any costs that accrue to the project and are directly attributable to such delay.
