Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Chapter 1 of Title 22.1 a section numbered 22.1-4.2 as follows:

§ 22.1-4.2. Designation of race or ethnicity by public school students.

School board employees administering tests or other assessment instruments shall disclose to the public school students being tested that such students are not required to respond to any inquiry regarding their race or ethnicity on any such test or instrument, and that they may respond to any such inquiry by indicating "other."
