An Act to amend and reenact § 58.1-3013 of the Code of Virginia, relating to authority to allow payment of local taxes, fees or other charges by credit and debit cards.

Be it enacted by the General Assembly of Virginia:

1. That § 58.1-3013 of the Code of Virginia is amended and reenacted as follows:

§ 58.1-3013. Authority to allow payment of local taxes, fees or other charges by credit and debit cards; service charge.

The treasurer of any county, city or town may accept payment of local taxes, other fees or charges generated by the sale of utility services by use of a credit card and debit cards. Any treasurer accepting credit and debit card payments may, in addition to any penalties and interest arising pursuant to §§ 58.1-3915 through 58.1-3918, add to such payment a sum not to exceed four and one-half percent of the amount of tax, penalty and interest paid, or six dollars, whichever is greater, as a service charge for the acceptance of such card. Such service charge shall not exceed the amount charged to the negotiated and agreed to in a contract with such county, city or town.
