Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 55-154.3 as follows:

§ 55-154.3. Mineral rights regarding migratory gases; presumption of ownership.

A. Except as otherwise provided by law, on or after July 1, 2000, all migratory gases, including, but not limited to, methane, shall be presumed to be the property of the owner of the surface real property beneath which such migratory gases are or may be located.

B. Litigation involving the legal construction of lease agreements entered into prior to July 1, 2000, shall be governed by the applicable law in effect at the time the lease agreements were entered into.
