Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 18.2-52.01 as follows:

§ 18.2-52.01. Multiple murders or felonious assaults; penalty.

A. If any person commits two or more violations of §§ 18.2-32, 18.2-32.1, 18.2-33, 18.2-51, 18.2-51.1, 18.2-51.2 or 18.2-52, or any combination of two or more violations of such provisions as part of the same act or transaction, he shall be guilty of a Class 3 felony.

B. A violation of this section shall constitute a separate and distinct offense. Punishment may be imposed for a violation of this section in addition to any punishment that may be imposed for violations of the predicate provisions enumerated in subsection A.

2. That the provisions of this act may result in a net increase in periods of imprisonment in state correctional facilities. Pursuant to § 30-19.1:4, the estimated amount of the necessary appropriation is $0 in FY 2010.
