007357736Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Article 21 of Chapter 3 of Title 8.01 a section numbered 8.01-226.7 as follows:
§ 8.01-226.7. Landlord liability under certain circumstances; lead-based paint.
Any landlord or landlord's agent who (i) has provided a tenant with the required lead-based paint literature and disclosure of any known or reported lead risks on the leased property, (ii) has obtained a signed statement from the tenant acknowledging the disclosure, as required by 42 USC 4852d, of any known or reported lead risks on such property, and (iii) maintains such property in compliance with the provisions of the Uniform Statewide Building Code relating to lead-based paint shall not be liable for civil damages in any action arising out of lead poisoning which is or may have been incurred from conditions on such property.
