AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend and reenact § 9-321 of the Code of Virginia, relating to the Specialized Transportation Council.

Be it enacted by the General Assembly of Virginia:

1. That § 9-321 of the Code of Virginia is amended and reenacted as follows:

§ 9-321. Membership.

The Council shall be composed of eleven members as follows: one representative of a small urban transportation provider, one representative of a rural transportation provider, two consumers, and one member at large, upon the recommendation of the chairman of the Disability Commission, appointed by the Speaker of the House; one representative of a large urban public transportation provider, one consumer, and one member at large, upon the recommendation of the chairman of the Disability Commission, appointed by the Senate Committee on Privileges and Elections; the Lieutenant Governor; the Secretary of Health and Human Resources; and the Secretary of Transportation. Members appointed shall represent the various geographical areas of the Commonwealth. Initial appointments shall be for terms as follows: one member appointed by the Speaker of the House and one member appointed by the Senate Committee on Privileges and Elections for two years; two members appointed by the Speaker of the House and one member appointed by the Senate Committee on Privileges and Elections for three years; and two members appointed by the Speaker and one member appointed by the Senate Committee on Privileges and Elections for four years. Thereafter, appointments shall be for four-year terms. Members appointed shall not be eligible to serve more than two consecutive full terms. The Secretary of Health and Human Resources Lieutenant Governor shall serve as the chairman of the Council and the Secretary of Health and Human Resources and the Secretary of Transportation shall serve as vice-chairman. The Governor shall appoint eight members, including a representative of a large urban public transportation provider, a small urban public transportation provider, and a rural transportation provider; three consumers; and two at-large members. Members appointed by the Governor shall represent the various geographical areas of the Commonwealth. Initial appointments by the Governor shall be for terms as follows: two members for two years; three members for three years; and three members for four years. Thereafter, all appointments shall be for four-year terms. Members appointed by the Governor shall not be eligible to serve more than two consecutive full terms vice-chairmen. Staff shall be provided by the Office of the Secretary of Health and Human Resources Disability Commission and assisted, as requested, by appropriate agencies within the two Secretariats.
