006100824Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Chapter 2 of Title 32.1 an article numbered 13, consisting of a section numbered 32.1-73.5, as follows:
§ 32.1-73.5. Reporting of [ abortion outpatient and inpatient surgical ]
complications.
In the exercise of its authority for health planning pursuant to Chapter 4 (§
32.1-102.1 et seq.) and for regulation of facilities and services pursuant to
Chapter 5 (§ 32.1-123 et seq.) of this title, the Board of Health shall require
reporting of, compile, and analyze data on complications resulting from any [
abortion procedure. Any physician, regardless of whether he performed the abortion,
who treats a patient experiencing complications from an abortion procedure
which occur within sixty days of the performance of the procedure shall report
to the Board on such complications in accordance with the Board's regulations.
The Board's regulations shall address, among other complications, any
infections, perforations, long-term reproductive dysfunction, and psychological
problems which have resulted from abortions outpatient and inpatient surgical
procedure. Any physician, regardless of whether he performed the surgical
procedure, who treats a patient experiencing complications from outpatient and
inpatient surgical procedures which occur within sixty days of the performance
of the surgical procedure shall report to the Board on such complications in
accordance with the Board’s regulations. The Board’s regulations shall address,
among other complications, any infections, perforations, and psychological problems which,
in the opinion of the attending physician, have resulted from such outpatient and inpatient
surgical procedures. ]
