004786824Be it enacted by the General Assembly of Virginia:
1. That § 9-6.25:1 of the Code of Virginia is amended and reenacted and that the Code of Virginia is amended by adding a section numbered 56-484.6:1 as follows:
§ 9-6.25:1. Advisory boards, commissions and councils.
There shall be, in addition to such others as may be designated in accordance with § 9-6.25, the following advisory boards, commissions and councils within the executive branch:

§ 56-484.6:1. Consumer Advisory Board for Virginia Relay established; duties; composition of board and terms of office; cause for removal; funding; staffing.
A. There is hereby established within the Department for the Deaf and Hard-of-Hearing the Consumer Advisory Board for Virginia Relay. Its duties and responsibilities shall include:
1. Ensuring through research and practical experience that the Virginia Relay is meeting the needs of its users;
2. Collecting feedback from consumers to be shared with the Virginia Department for the Deaf and Hard-of-Hearing, the Department of Information Technology, and the contractor;
3. Providing advice on meeting the requirements for functional equivalence required by law;
4. Assisting in transmitting information from the administering agencies and contractor to consumers;
5. Providing access to consumers and other interested parties through meetings held in various regions of the Commonwealth as determined by the Advisory Board; and
6. Providing other assistance to the Board of the Virginia Department for the Deaf and Hard-of-Hearing as requested.
B. The Advisory Board shall be composed of eleven members to be appointed by the Governor representing the various regions of the Commonwealth and the following specific interests: one from a statewide consumer organization of deaf individuals; one from a statewide consumer organization of hard-of-hearing individuals; one from a statewide organization of late-deafened individuals; one with a physical or sensory disability from a statewide organization of Centers for Independent Living; one from a consumer organization of speech-impaired individuals; one from a consumer organization of deaf-blind individuals; two hearing individuals who use Virginia Relay; and one representative each from the Virginia Department for the Deaf and Hard-of-Hearing, the Department of Information Technology, and the State Corporation Commission. The Board shall also include a representative of the contractor who shall be a nonvoting member.
C. The term of office for appointed members of the Advisory Board shall be three years except for the initial appointments, which shall be staggered in the following manner as decided by the Board: three members shall serve one year, four shall serve two years, and four shall serve three years. At the completion of his term, a member of the Board shall continue to serve until a successor is appointed. Advisory Board members may serve no more than two full consecutive terms. Any vacancies created by resignation or other means shall be filled to meet the same qualifications as the original position and the person appointed to fill the position shall serve for the unexpired term.
D. The Governor may remove a member of the Board for incompetence, neglect or malfeasance.
E. Funding for expenses for the Board and its duties shall be funded by a portion of the proceeds from the telecommunications relay service fund, collected by the State Corporation Commission.
F. The Department for the Deaf and Hard-of-Hearing shall supply personnel to support the operation of the Board and provide other assistance as the Board requests. Funding for these purposes shall also come from a portion of the telecommunications relay service fund.
