An Act to amend the Code of Virginia by adding in Chapter 35.2 of Title 2.1 an article numbered 9, consisting of sections numbered 2.1-563.42, 2.1-563.43 and 2.1-563.44, relating to security of government databases.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Chapter 35.2 of Title 2.1 an article numbered 9, consisting of sections numbered 2.1-563.42, 2.1-563.43 and 2.1-563.44, as follows:

Article 9.
Security of Government Databases.

§ 2.1-563.42. Governor to designate the responsible entity.

To ensure the security of state government databases and data communications from unauthorized uses, intrusions, or other security threats, the Governor shall direct an appropriate government entity to be responsible for conducting security audits.

§ 2.1-563.43. Powers and duties of the designated entity.

The government entity so designated by the Governor under this article shall perform or cause to be performed periodic audits of all executive branch agencies and institutions of higher education regarding security procedures for protecting the government databases and data communications. Such audits may include, but are not limited to, on-site audits as well as reviews of all written security procedures. The designated entity may contract with a private firm or firms that specialize in conducting such audits subject to approval of the Governor.

§ 2.1-563.44. Government entities to cooperate.

All government entities subject to such audits as required by this article shall fully cooperate with the entity designated to perform such audits.
