On and after July 1, 2000, and prior to the adoption of regulations promulgated pursuant to subsection D, absent the issuance of a permit by the U.S. Army Corps of Engineers pursuant to § 404 of the Clean Water Act, no person shall, without compensating the impact of the wetland to the satisfaction of the Board, in a manner sufficient to achieve no net loss of existing wetland acreage and functions, conduct the activity of ditching in a wetland.
