4. The State Crime Commission shall study the methods, legal issues and costs of implementing a fair and economical program of random or reasonable suspicion drug testing of all inmates incarcerated in local and state correctional facilities and recommend to the 2001 General Assembly Session specific legislation and funding for a program that would (i) guarantee that all felons whose screening at conviction indicates the presence of a substance abuse problem will have access to treatment while incarcerated and (ii) establish a program of post-incarceration testing and treatment that would require any prisoner to be referred for treatment on a first positive test following incarceration and require prisoners who refuse treatment at the time of a positive test and those who fail second and subsequent drug tests to serve additional time on their sentences in addition to being required to undergo intensive supervision for a period following release.
